What are the guidelines on returning a security deposit? Topic: On the case security

Question: My mom lives in a 3 bedroom apartment which is gated and has cameras but a little over a week ago they broke into her apartment and took almost everything. The place looks trashed because they basically threw everything out of the closets, drawers, and cabinets but the only real apartment damage was the window they broke to get into the apartment. My mother is not allowed to go in to clean the apartment because the detective does not want any prints to be contaminated so the place obviously still looks a mess. She now wants to move but the landlord is saying that she trashed her complex and is not entitled to her security deposit. There is still an on going investigation as to who it could have been but I just want to know if the landlord is acting properly or if she is entitled to fight for her deposit. Any help would be awesome please.

Who is "they"? Unless it was the landlord, then your mother has no reason to move or to forfeit her deposit. A tenant's renter's insurance should cover damage of this type and should also cover temporary accomodations in cases like this. But there is NO legitimate reason here for her to break a lease; if she does, the security deposit would be the least of her problems. The landlord can sue for all of the rent due until another tenant is found, and can certainly sue for any damages to the property as well.

There should always be something to do... make rounds, check out a suspicious vehicle, document a description of a suspicious person walking by, etc. Worse case, make an entry stating "no activity".

Patrolled (enter area of property here) by foot (and vehicle if applicable). everything appears to be secure at this time. notice the "appears"? never, never, NEVER use definites in a report unless you are 110% sure that nothing is wrong or happened. Remember that your report is a document to back you up as a witness and detailed narrative of who, what, when, why, and where. Like the trooper said...there always something to write down!

She doesn't have a right to the deposit b/c she is leaving without notice. The condition of the unit is irrelevant.
